BUSINESS AND NONINSTRUCTIONAL OPERATIONS

School Lunch/Breakfast - Sale of Food Items

  1. State Board Regulation

    The sale of food and drink items in school during the school day shall be limited to those items recognized as being components of the school lunch and breakfast programs, and the income from the sale of those items shall accrue to the school lunch account.

    This Regulation does not prohibit the sale of a la carte items. It does limit the a la carte items to those items that meet the nutritional standards established by the Healthy, Hunger-Free Act of 2010. These standards apply to all food sold a la carte and food sold in school stores, snack bars and vending machines.

    All income from sale of non-program food items during the school day shall accrue to the school lunch account.

  2. School Division Regulation

    These items cannot be sold to students on school premises (all areas of the school) during any scheduled Breakfast or Lunch Period:

    1. Chewing Gum
    2. Certain Candies
      1. Hard Candy
      2. Jellies and Gum Candies
      3. Marshmallow Candies
      4. Fondant
      5. Licorice
      6. Spun Candy
      7. Coated Popcorn
    3. Water Ices
    4. Soda Water (carbonated beverages)

    The prohibition applies only to students. This Regulation does not prohibit the sale of these items to employees when in areas only for employees.
